1. What types of advertising on cars are there?

The types of cars currently participating in advertising in Vietnam are very diverse, including buses, taxis, private cars, electric cars, trucks, coaches…

2. Regulations on car advertising

The law on car advertising applies to all of the above forms of advertising.

2.1. Applying for a license to advertise on cars

Good news for drivers and businesses interested in car advertising registration procedures: the requirement to apply for an advertising license has been removed.
According to the amendments and supplements to the Advertising Law effective from January 1, 2013, advertising on means of transport does not require an advertising license.

Therefore, implementing and running advertising campaigns on vehicles in general and cars in particular becomes much quicker. However, this does not mean there are no binding regulations for this form of communication.

2.2. Law on sticking advertisements on cars

Regulations on advertising on cars are clearly stated in Article 32 – Advertising Law on Means of Transport as follows:

“1. Advertising on means of transport must comply with this Law and traffic laws.

  1. It is not allowed to display advertising products on the front, rear, and roof of the vehicle. Advertising products must not exceed 50% of the area of each permitted side of the vehicle.

  2. The display of symbols, logos, or emblems of the vehicle owner or car brand on the vehicle must comply with traffic laws.”

As you can see, in these regulations, factors such as advertising position, advertising area, or advertising content are still strictly managed.

2.3. Products prohibited from advertising

Like all other media channels, regulations on advertising on cars also require investors to clearly identify products that are prohibited from being advertised.
According to Article 7 – Products, Goods, Services Prohibited from Advertising, the following are included:

  1. Goods and services prohibited from trading under the law.

  2. Tobacco.

  3. Alcohol with an alcohol content of 15 degrees or more.

  4. Breast‑milk substitutes for children under 24 months old, nutritional supplements for children under 06 months old; bottles and artificial nipples.

  5. Prescription drugs; non‑prescription drugs that are recommended by competent authorities to limit use or to be used under physician supervision.

  6. Products, goods of a sexual nature.

  7. Hunting rifles and ammunition, sports weapons, and products that incite violence.

  8. Other products, goods, and services prohibited from advertising as prescribed by the Government when arising in practice.

Therefore, you must refuse if any investor trading these goods asks to place advertisements on your car or use car advertising services.

2.4. Penalties for advertising violations

If you are not familiar with the regulations—or know them but still violate them—the penalties are clearly stated in Article 61, Decree No. 28/2017/NĐ-CP as follows:

“A fine from 2,000,000 VND to 5,000,000 VND shall be imposed for any of the following acts:

• Advertising on the front, rear, or roof of the vehicle.
• Advertising exceeding the permitted area on each side of the vehicle.”

3. Procedures for registering car advertising

Although the procedure for applying for a license has been abolished, investors still need to submit a notification dossier of the advertising product.

To complete the registration procedure for advertising on cars in accordance with the law, you need to prepare a dossier including the following documents:

  • A written notification of the advertising product stating clearly the content, duration, and means of advertising.

  • A copy of the business registration certificate.

  • A copy of documents proving conformity of products, goods, services as prescribed by law, or documents proving eligibility for advertising.

  • The maquette of the advertising product.
